TERMS AND CONDITIONS

Read the Terms and Conditions of use carefully before using our website and booking or receiving any appointment.

This website is owned and operated by Body Care Solution LLC. These Terms set forth the terms and conditions under which you may use our website www.bodycaresolutiondayspa.com  (“The Website”) and services as offered by us. 

 

You must agree to these Terms and Conditions in order to use the Body Care Solution  LLC  ”Massage & Waxing SPA” (“Massage and Waxing SPA,” "we," "us," or "our") website and to receive any of the Services (Waxing, Facial, Body Contouring, Body Treatments and Therapeutic Massage services) offered by Massage & Waxing SPA. 

 

If you do not agree to this Agreement, you may not use the Website or either of the Applications.

 

These Terms of Service should be read along with our "Privacy Policy" ,  " Spa  Policy"  and all other operating rules, policies, terms and conditions published on The Website.

 

Body Care Solution  LLC  ”Massage & Waxing SPA”  may revise and update these Terms and Conditions at any time. Therefore, we encourage you to review this Site and these terms and conditions for any updates or changes on a periodic basis. 

 

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in the United States, California or under any law or regulation applicable to you.

OUR SERVICES 

We are providing you information about  services offered at ”Massage & Waxing Day SPA” through The Website including Waxing, Facial, Body Contouring, Body Treatments and Therapeutic Massage services along with the ability to schedule or cancel appointments.You must have all equipment necessary for accessing The Website , access to the Internet to use the Website and Mobile Application, and pay any fees related with such Internet or equipment. 

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

CONSUMER TERMS

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations require us to give you certain key information for there to be a legally binding contract between you and us. Details on how to make a booking are set out below. If we wish to change any key information once a legally binding contract is made, we can only do this if you agree to it.

BOOKING PROCESS & PAYMENT

You can make a booking through Our Website.

Unless otherwise agreed during the booking process, payment will only be accepted by card or PayPal account.

Your card payment details will be requested at the time of booking and part of payment will be collected when you make a booking. This amount is not refundable in case no show or no cancellation Full details of the prices are referred to below.

We will do all that we reasonably can to ensure that all of the information you give us when paying for services is secure by using an encrypted secure payment mechanism. However, in the absence of negligence on the part of Massage & Waxing Day SPA, we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you may give us at any time.

All payments by credit card or debit card need to be authorized by the relevant card issuer. We may also need to use extra security steps via Verified by Visa.

By making a booking or buying Gift Certificate you agree to provide complete, correct and true information including without limitation billing and payment information.

Once your booking is accepted and confirmed you will receive confirmation of your appointment by text messages and email.

All down payments are payable through Our Website as part of our booking service.

CUSTOMER RESPONSIBILITIES

In addition to the responsibilities noted above, it is your responsibility to provide complete and accurate information at the time of booking. Failure to provide complete and accurate information may result in a rejection of your booking request, cancellation of your booking or an inability of the booked Independent Practitioner to provide the service as requested. Such failure may also result in loss or incorrect delivery of your booking confirmation.

CANCELLATION & REFUNDS

You have a contractual entitlement to cancel any booking you have made with an Independent Practitioner through us at least 3 hours before the start time of the Service. For cancellations within 3 hours of the booked start time, the full amount of prepayment is payable. If  you  made  an  appointment  online with  prepayment,  you  have an option  to reschedule your  appointment  no  more  than three times. Your third  appointment  will be  final and non  refundable.

You have to share with us your intention to cancel the booking through an office call, text message or make a cancellation sending email to us. You must receive the cancellation confirmation from Massage & Waxing Day SPA finalizing this request.

If you have made a cancellation as mentioned above, all the refunds will be made in the three to five (3-5) business days following the date when you share with us your intention of cancelling the booking. The refunds will be made using the same payment method as the one used for the initial transaction. No exchange to cash back will be made. 

You will also be charged the prepayment Fee by us if you:

• Cancel a booking other than as permitted above i.e. outside of the 3 hour notification period;

• Attempt to cancel a booking on or after Service Appointment Time; or

• Fail to attend a booking at the Service Appointment Time and/or at the Designated Premises.

Cancellation fees may in our absolute discretion be waived where you have been unable to cancel a booking without incurring the cancellation fee for genuine reasons which were outside of your control.

EXTENSIONS AND DELAYS

If you wish to extend the time you have booked  the Massage Therapist or Esthetician will attempt to satisfy your request. This subject to the availability of the Practitioner and also payment of an additional charge for the extended time calculated in accordance with our Prices .

PROHIBITED USE

Our Services are for your personal and non-commercial use and must only be used for the purposes of inquiring about or making bookings for services as expressly described above. You must not use the Site or the phone Booking Services to do any of the following which are strictly prohibited:

• Engage in any inappropriate behavior including but not limited to illicit or sexually suggestive remarks, sexual advances, drug use, excessive drinking and/or other inappropriate behavior;

• Restrict or inhibit any other user from using and enjoying Our Booking Services;

• Infringe the privacy rights, property rights, or other civil rights of any person;

• Harass, abuse, threaten or otherwise infringe or violate the rights of Massage Therapists and Estheticians;

• Harvest, data-mine or otherwise collect information about others, including email addresses, without their consent;

• Use technology or other means to access our computer network, unauthorized content or non-public spaces;

• Introduce or attempt to introduce any viruses or any other harmful code, files or programs that interrupt or otherwise or limit Our Booking Services functionality;

• Damage, disable or otherwise impair our servers or networks or attempt to do the same; and

• Engage in or encourage others to engage in criminal or unlawful conduct or breach these Terms including misuse of Our Booking Services for unlawful or unauthorized purposes.

You agree not to breach these Terms in any way which may result in, among other things, termination or suspension of your access to Our Booking Services.

INTELLECTUAL PROPERTY

Body Care Solution LLC, Massage & Waxing Day SPA, the Massage & Waxing Day SPA logo and all other intellectual property rights, service marks, graphics and logos used in connection with Our Website and/or the Services (whether registered or unregistered) belong to us and are protected by intellectual property law. Nothing in these Terms grants you any rights in the Site or Booking Services or the content within the same. All rights are reserved.
